Name of Your Property

1. Sale Method
Thank you for your kind instructions. We will offer the above freehold property for sale by private treaty with sole selling rights shared with the named joint sole agent .................................................

2. Guide Price
It was agreed that the property will be marketed quoting a guide price of £XXX,XXX which we will advertise in both pounds sterling and Euros.

3. Sales Brochures and Particulars
Under the terms of the Property Misdescriptions Act 1991 it is essential that all information incorporated in the particulars of sale is factually accurate and not a matter of opinion. Check our particulars carefully and sign them off.

a) Produced in-house
The most important initial selling tool for your house is a high quality colour photograph taken on a fine day. Please do not rush this. Alert a professional architectural photographer and tell him at what time of day the house looks its best. We will need one excellent original photographic print or a 300dpi digital image, from which to produce colour brochures—please, not a transparency, photocopy or printed photograph from a newspaper or magazine.
b) Professionally printed
If your property is offered for sale at a guide price of over £500,000, we strongly recommend producing an 8 page printed colour brochure with floor plans and comprehensive details. Samples and prices for this work are available on request. We can also offer an economical but attractive brochure printed in colour on both sides of an A4 card. In each case a professional architectural photographer will be commissioned, and estimates of the cost can be given.

4. Marketing

a) Applicants
We email full details of your property to everyone on our database who is looking for listed and unusual buildings in your area and price range. This list is continually pruned and updated according to the reaction to media coverage of properties available through Pavilions of Splendour. It normally consists of up to two thousand names of people who have contacted us within the past six months.
b) Editorial Coverage
We will send information about your property to the national media. Pavilions of Splendour commands considerable attention from the property press, as the properties we sell are inherently newsworthy. We are unable fully to market properties through the media without high quality photographs, as journalists will not include buildings without visual support.
c) Internet
We will scan at least three colour ‘blue sky’ photographs supplied by you of your property and load a full description and particulars of the property onto one or two pages on the architectural heritage Web site, www.heritage.co.uk.
The site receives up to 4 million hits a week from interested buyers all over the world and has been the UK’s foremost heritage property site since its inception in 1994.
d) Central Register of Listed Buildings For Sale
We will ensure that basic details of your property are placed on the Central Register of Listed Buildings For Sale, published weekly in full on the internet. The register is a unique service providing, at a glance, some of the best historic properties for sale in the country.
e) Advertising
We recommend a degree of local advertising be undertaken by the joint sole agent. We recommend that a lineage advertisement be booked into the Sunday Times and the Daily Telegraph. In addition, if your property is offered for sale at a guide price of over £500,000, we recommend a colour advertisement in Country Life, still the most influential weekly medium for property advertising. The costs of these advertisements can be given on request.

5. Planning
It is essential that we have written confirmation of any planning application or consent concerning the property prior to going to the market.

6. Listing
Please supply written evidence of the official grade listing of your property, available for properties in England from the Listed Buildings Information Service on 020 7208 8221.

7. Council Tax
Please advise us of the council tax banding of the property.

8. Solicitors
Please advise us of the name and address of your solicitors to whom the monies from the sale should be paid. We will supply them with a copy of this signed contract.

9. Fees and Expenses
Pavilions of Splendour's standard joint sole agency fee is 1.25% (plus VAT) of the sale price, with a minimum fee to us of £1,000. Our fee is due upon exchange of contracts and will be paid by your solicitor out of the sale monies on completion if we introduce to you a ready willing and able purchaser at the agreed guide price or above or if at any time unconditional contracts for the sale of the property are exchanged with a purchaser with whom we had negotiations about the property or with a purchaser introduced by any other agent during the period of our joint sole agency. You are responsible for negotiating the separate fee payable to our joint sole agent and for settling that fee. Any marketing expenses previously agreed with you and incurred by us, such as external brochure production and advertising, are payable in advance in addition to any fee. Interest will accrue under the Payments of Commercial Debts (Interest) Act 1998 if monies due to us are not paid at the time of completion.

10. Terms of Business
We are required by the Estate Agents Act 1979 to confirm our terms in writing to you as our client. This document constitutes those terms. Should you wish to proceed along the terms as laid out herein would you please sign the extra copy of this letter attached prior to our proceeding. This letter is for marketing purposes only and does not constitute a valuation.

11. Contact
We will maintain regular contact with you, and would greatly appreciate details of alternative contact points and telephone numbers, so that we are always able to negotiate on your behalf with a potential purchaser for your property.
